1. Definitions

In these Terms & Conditions, references to "the Company," "we," "us," or "VCT" refer to Vanilla Cow Travel Company. References to "the Client," "you," or "your" refer to the person booking the tour and, where applicable, each guest traveling under that booking. References to "NCL" refer to Norwegian Cruise Line.

2. Nature of This Reservation

Vanilla Cow Travel Company ("VCT," "we," "us") is a Florida-registered Seller of Travel (ST44055) and CLIA-accredited tour operator. This tour is offered as part of a group block reserved by VCT with Norwegian Cruise Line ("NCL"). VCT is not an employee, agent, or partner of NCL. Your reservation with VCT is a request to be included in this group block and is not a confirmed cabin reservation until deposit is received and accepted, and cabin assignment is confirmed by NCL.

3. NCL Terms & Conditions

VCT acts solely as your booking agent for this cruise. Once your reservation is confirmed and your cabin is booked, you are a direct guest of Norwegian Cruise Line, and you will receive booking confirmations, pre-cruise communications, and cruise documents directly from NCL. By booking this cruise, guest acknowledges and agrees to be bound by NCL's Guest Ticket Contract and all other NCL terms, conditions, and policies available at https://www.ncl.com independently of and in addition to these VCT Terms & Conditions. These VCT Terms & Conditions govern VCT's services as your booking agent; NCL's own terms govern the cruise itself, including but not limited to onboard conduct, liability, ticket contract terms, and NCL's cancellation and refund policies. In the event of any conflict between these two sets of terms regarding the cruise itself, NCL's terms will govern.

4. Where to Find NCL's Full Terms

Norwegian Cruise Line's Guest Ticket Contract and Group Terms & Conditions govern the cruise itself and include important provisions on ship substitution, itinerary changes, travel documentation, and NCL's own limitations of liability. VCT does not reproduce NCL's contract terms here. Guests are strongly encouraged to review NCL's complete, current terms directly at https://www.ncl.com guest ticket contract section or by contacting NCL directly, prior to booking and prior to sailing.

5. Pricing

Posted per-person, double-occupancy pricing reflects VCT's curated group package rate and is not the discounted group rate extended to VCT by NCL. Final pricing, including any applicable taxes, fees, and port expenses, will be confirmed at time of individual booking. Prices are subject to change until deposit is received.

6. Deposit Schedule

● A deposit of $250.00 per person is due to secure your place in this group tour.

● Full and final payment is due no later than December 26, 2027 (120 days prior to departure).

● Reservations made within 120 days of departure must be accompanied by payment in full.

● Deposits and payments are made to Vanilla Cow Travel Company, not directly to Norwegian Cruise Line.

● Deposits are refundable on a sliding scale based on how far in advance you cancel. See Section 7, "Cancellation Policy," for the applicable fee at the time of cancellation.

7. Cancellation Policy

Cancellations made by the guest are subject to the following schedule, calculated from days prior to the voyage departure date (April 24, 2028). Fees apply to total payments made or deposit, whichever is greater.

This schedule mirrors, and in no case is more lenient than, Norwegian Cruise Line's group cancellation policy under the VCT group contract.

8. Roommate / Cabin-Mate Cancellation

Cabin pricing is quoted per person based on double occupancy — meaning the total cost of the cabin is split between the two guests sharing it. If one guest sharing a cabin cancels, the total cost of that cabin does not change. The remaining guest is responsible for paying the difference so that the full cabin cost is covered, in addition to any separate cancellation fee owed by the cancelling guest under Section 7.

For example: if a Balcony cabin costs $1,700 per person at double occupancy, the total cabin cost is $3,400. If one guest cancels, the remaining guest owes whatever amount brings their total payment up to $3,400 for the cabin — not just the original $1,700 they were quoted. This is because cruise lines charge based on the cabin as a whole, not strictly per person, and a cabin occupied by one guest is billed at the single occupancy rate rather than the double occupancy rate.

9. Changes to Bookings

Name changes, date changes, and cabin category changes are subject to approval by Norwegian Cruise Line and are not guaranteed. Per NCL's Group Contract, name revisions or substitutions are not permitted without NCL's approval, and any approved name change is treated as a cancellation and new booking, subject to the cancellation fee schedule in Section 7 in effect at the time of the change.

Any request to change sail date, cabin category, or itinerary after deposit is received will be treated as a cancellation of the original booking (subject to Section 7) and a new reservation, subject to space and pricing availability at the time of the request. VCT will make reasonable efforts to accommodate change requests but cannot guarantee availability or pricing once a request is submitted.

10. Final Payment

Final payment in full is due by December 26, 2027. Payments not received by this date may result in cancellation of the reservation and application of the cancellation fees described in Section 7, and release of the cabin back to the group block.

11. Passport & Travel Documentation

Guests are solely responsible for obtaining and carrying a passport valid for at least six (6) months beyond the disembarkation date, along with any visas or documentation required for each country visited on this itinerary. VCT and NCL are not responsible for denied boarding due to inadequate or expired travel documents. Cancellations resulting from insufficient travel documentation are subject to the cancellation fees in Section 7 and are not refundable.

12. Travel Insurance

Travel insurance is strongly recommended and is not included in the tour price. Given the cancellation fee schedule above, VCT encourages all guests to purchase a travel protection plan at the time of deposit.

13. Vendor Contact Prohibition

Guests agree not to contact Norwegian Cruise Line, its group department, or any other tour vendor directly regarding pricing, cabin assignments, deposits, or contract terms. All communications regarding this group booking must go through Vanilla Cow Travel Company. This ensures pricing, cabin assignments, and group amenities are correctly applied and protects the integrity of the group block.

14. Changes to Itinerary

Ports of call, arrival/departure times, and onboard offerings are set by Norwegian Cruise Line and subject to change without notice due to weather, operational, or other reasons outside VCT's control. VCT is not liable for itinerary changes made by NCL.

15. Group Space Limitations

This group tour is limited to a maximum of six (6) paying guests plus host. Cabin categories and availability are limited to the space held in VCT's group block and are offered on a first-deposit, first-confirmed basis.

16. Limitation of Liability

Vanilla Cow Travel Company acts solely as a tour operator and booking agent, arranging cruise and travel services provided by third-party suppliers, including but not limited to Norwegian Cruise Line, airlines, ground transportation providers, hotels, and shore excursion operators. VCT does not own, operate, or control any of these third parties and is not responsible for their acts, omissions, delays, cancellations, or defaults.

Without limiting the foregoing, VCT is not liable for: airline delays, cancellations, schedule changes, missed connections, or lost baggage; weather conditions or other events outside VCT's control (including hurricanes, storms, or port closures) that affect the itinerary, embarkation, or disembarkation; or injury, illness, loss, or death arising during any shore excursion, tour, or other activity operated by a third party, whether or not booked through VCT. Guests engage in all onboard and shore activities entirely at their own risk.

VCT's total liability to any guest, under any theory, is limited to the amount of fees VCT actually retained for its own booking and coordination services, and does not extend to any portion of the cruise fare, air, hotel, or third-party costs paid to those suppliers.

17. Payment Method & Credit Card Authorization

Guests paying by credit or debit card represent and warrant that they are the authorized cardholder, or have the express written authorization of the cardholder, to use the card for this reservation. VCT reserves the right to request government-issued photo ID and/or additional verification before processing any payment if fraud is suspected.

By submitting payment, the guest authorizes VCT to charge the card provided for all deposits, balances, and amounts due under this reservation, including any amounts owed as a result of cancellation fees described in Section 7.

Guests agree not to dispute or initiate a chargeback for services that were rendered, or for cancellation fees properly assessed, in accordance with these Terms & Conditions. A chargeback initiated in violation of this section will be treated as a cancellation as of the date of the chargeback and is subject to the cancellation fee schedule in Section 7, plus any bank or processing fees incurred by VCT as a result. VCT reserves the right to pursue collection of any amounts owed, including through third-party collection services, and to decline future bookings from any guest who initiates a fraudulent or improper chargeback.

VCT reserves the right to refuse any payment method and to require an alternate form of payment if fraud, unauthorized use, or suspicious activity is suspected.

18. Governing Law

These Terms & Conditions are governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles. Any dispute arising out of or related to VCT's services under this reservation shall be resolved exclusively in the state or federal courts located in Florida. This section governs disputes with VCT only; disputes relating to the cruise itself are governed by NCL's own Guest Ticket Contract, as described in Section 3.

19. Force Majeure

VCT shall not be liable for any failure or delay in performing its obligations, or for any loss or damage arising from circumstances beyond VCT's reasonable control, including but not limited to acts of God, natural disasters, pandemic or epidemic, government action or travel advisories, civil unrest, labor disputes, or the acts or omissions of NCL or any other third-party supplier. This section addresses VCT's own obligations as booking agent and is separate from, and does not limit, NCL's own force majeure or similar provisions under its Guest Ticket Contract.

20. Assumption of Risk

Client acknowledges that travel, including but not limited to cruising, air travel, ground transportation, and shore excursions, involves inherent risks, including but not limited to illness, injury, accident, delay, and, in rare cases, death. Client voluntarily assumes all such risks and agrees that VCT's role is limited to arranging and coordinating travel services on Client's behalf as a booking agent.

21. Fitness to Travel & Medical Disclosure

Client represents that Client and all guests traveling under this booking are physically fit to travel and to participate in the itinerary as planned. Client is responsible for disclosing to VCT and to NCL, in advance of sailing, any medical condition, mobility limitation, or special need that may affect the guest's ability to travel or that may require accommodation. VCT is not responsible for a guest's inability to participate in any portion of the itinerary due to an undisclosed or pre-existing medical condition.

22. Code of Conduct

VCT reserves the right, in its sole discretion, to remove any guest from this group tour, without refund, prior to or during the trip, for conduct that is disruptive, abusive, illegal, or that threatens the safety or enjoyment of other guests. Any such removal is separate from, and does not limit, NCL's own right to deny boarding or remove a guest from the ship under its own Guest Ticket Contract.

23. Entire Agreement

These Terms & Conditions, together with NCL's Guest Ticket Contract and Group Terms referenced herein, constitute the entire agreement between Client and VCT regarding this reservation, and supersede any prior verbal or written representations, including any statements made during initial inquiry or booking calls. No employee or representative of VCT has the authority to modify these Terms & Conditions except in writing signed by an authorized representative of VCT.

24. Severability

If any provision of these Terms & Conditions is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be severed, and the remaining provisions shall continue in full force and effect.

25. Complaints & Notice

Any complaint regarding VCT's services under this reservation must be submitted in writing to VCT within thirty (30) days of the completion of the trip. VCT will make reasonable efforts to address complaints submitted within this window but is not obligated to consider complaints submitted after this period. This section does not apply to complaints regarding NCL's own services, which should be directed to NCL directly.

26. Marketing & Photo Release

Client grants VCT permission to photograph or video Client and any guests traveling under this booking during the tour, and to use such images or footage in VCT's marketing materials, website, and social media, without compensation to Client. Any guest who does not wish to be photographed or included in such materials must notify VCT in writing prior to travel.

27. Acceptance

Submission of a deposit constitutes acceptance of these Terms & Conditions in full.
